Terms of Service

By using neyrinck.com, app.neyrinck.com, or any Neyrinck software (collectively, the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

Neyrinck LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use our software for your personal or business purposes, subject to these terms and any product-specific license agreement.

You may not: (a) reverse-engineer, decompile, or disassemble the software except to the extent required by applicable law; (b) redistribute or sublicense the software; (c) remove or obscure proprietary notices; (d) use the Service for unlawful purposes.

All content, software, designs, and trademarks on the Service are owned by Neyrinck LLC or its licensors and are protected by US and international intellectual property laws.

When you submit feedback, bug reports, feature requests, or other content to us (including Pro Tools^® session files), you grant Neyrinck a worldwide, royalty-free, non-exclusive license to use that content for the purpose of operating, maintaining, and improving the Service. We will not publicly disclose your submissions or share session files outside of our team without your permission.

You are responsible for keeping your account credentials secure. We may suspend or terminate accounts that we believe have been compromised or that are used to violate these terms.

Your use of the Service is also governed by our Privacy Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Neyrinck does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEYRINCK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, REGARDLESS OF THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID NEYRINCK FOR THE SERVICE IN THE 12 MONTHS PRIOR, OR (B) USD 50.

You agree to indemnify and hold harmless Neyrinck LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these terms. The license provisions, disclaimers, and limitations of liability survive termination.

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute arising out of these terms will be resolved exclusively in the state or federal courts located in California.

We may update these terms from time to time. Material changes will be announced on this page with an updated effective date. Continued use after a change indicates acceptance.
